Prosecutor Asks for up to 3 Year Sentence for Libby

From the AP:

Former White House aide I. Lewis "Scooter" Libby betrayed the public's trust and deserves to spend 2 1/2 to 3 years in prison for obstructing the CIA leak investigation, Special Prosecutor Patrick Fitzgerald said Friday....

U.S. District Judge Reggie B. Walton has broad discretion over Libby's fate. Walton faces two important questions: whether to send Libby to prison and, if so, whether to delay the sentence until his appeals have run out.

Libby's lawyers have not filed their sentencing documents yet but are expected to ask that he receive no jail time. They have said that if Walton orders prison time, they will ask that Libby be allowed to remain free during appeals.

What's stopping the court -- under Geneva -- imposing the same punishment afforded to POWs: Send Libby to Guantanamo; why is a former US government attorney being treated in court differently [access to counsel, punishment, probabilty of punishment without trial] than a POW, in violation of Geneva?

Many innocents at Guantanamo aren't given the chance to "remain free pending appeal." Why the double standard, which violates Geneva?

AMeican lawyers like the Constitution if it keeps their reckless friends in the US government immune to accountability; but first chance, the lazy legal profession will do nothing as that same legal community destroyes the Constitution. Anything which any GOP Staffer or EOP-DoJ-WH counsel did to destroy/ignore/violate the COnstitution to any American should be applied to Libby: Denied the same rights.

If not, explain why American civilians -- without judicial process -- have been denied righs, liberties, discretion, and the freedom to be free from unreasonable searches -- yet, Libby apparently enjoys More Orwellian status.

Some laywers are more equal than Americans. Not impressed with the double standard, lawyers.

An important piece of news contained in Fitzgerald's memorandum is that investigators from an early point determined that Plame was indeed covert under the definition of the term in the Intelligence Identities Protection Act, and therefore that the disclosure of her identity to reporters could indeed have violated the IIPA. Doesn't mean such a violation did occur. But one of the main arguments propagated on the right by the likes of Victoria Toensing has been that Plame was not covert under IIPA, Fitzgerald knew this, and therefore there could not have been such a violation, and therefore the investigation should never have been gotten off the ground.

That argument is now definitively shown to be false.

Out of jail while on appeal? I hope they are kidding. This man was part of a conspiracy that exposed a covert agenda as well as her network. Sounds like treason to me. I think perhaps the good judge should order a damage assessment that shows the cost in lives, covers and the exposure of Brewster Jennings and then decide. I know he isn't the mastermind, but he was a very well informed, attorney and a person in his position should be held to a higher standard!

Walton has been on the U.S. District Court in Washington since he was appointed by President Bush in 2001.

He was catapulted into the limelight by the high-profile trial of Libby, convicted of lying to the FBI and a grand jury about the administration's leak of the identity of a covert CIA agent, Valerie Plame.

But it was not the first time he had been in the news.

Secrecy News noted that in July 2006 he had ruled in favor of the Federation of American Scientists in a Freedom of Information Act lawsuit against the National Reconnaissance Office.

Earlier last year FBI whistle-blower Sibel Edmonds unsuccessfully tried to get Walton to recuse himself from her case, arguing his decision to keep federally required financial disclosure information private created the appearance of a conflict of interest.
