Leahy to Gonzales: Answers, Please

Just a taste of what's to come.

In a letter today to Attorney General Alberto Gonzales (who's doggedly preparing for his upcoming testimony), Senate Judiciary Chairman Pat Leahy (D-VT) scolded Gonzales for failing to respond to prior questions from the committee and requested that Gonzales prepare a written statement in advance of his April 17 hearing. Leahy said the statement should include "a full and complete account of the development of the plan to replace United States Attorneys, and all the specifics of your role in connection with this matter."

Leahy also not so subtly rebuked Gonzales and the administration for publicly complaining about the late hearing date; the White House has said they want it "sooner rather than later" to "get the facts." Leahy wrote: "As you will recall, my staff had requested earlier dates..., but you had declined those offers."

And after detailing Gonzales' failures in providing answers to written questions from the committee -- sometimes ignoring questions for as long as six months -- Leahy concluded:

You would not tolerate this kind of response time in a Justice Department investigation where months go by without answers and when those answers are finally provided they are outdated or superseded by events. That is not conducive to effective oversight.

If Orrin Hatch under whatever circumstances replaces Alberto G. a AG what happens' to Hatch's Senate seat? When is Hatch up for reelection? Who is Utah's governor? I think I can guess at the answers to the next questions, but what is the governor's party and which party control Utah's legislature?

A few questions: Does the reversal of the Patriot Act provision that allowed appointments without confirmation need to be signed by Bush even though it was adopted with a supermajority? And when it does become law, do the various appointees then step down (they've been in longer than 120 days) and the federal courts appoint a replacement until Senate confirmation of whoever Bush appoints? Can we thus get a nonpartisan DC USA to prosecute contempt of Congress?

Monica can presumably extend her leave of absence indefinitely, so long as she's in a "leave without pay" situation. The real question is who's paying her high-priced lawyer, the one who keeps writing letters to the Judiciary Committee? As a Federal employee, Monica is under legal employee ethics restrictions that prevent her from receiving "gifts, benefits or favors" of more than token value (less than $50/year). She appears to be in massive violation of these laws.

However, when I read the text of the bill passed overwhelmingly by Congress revoking this indefinite-interim-appointment-without-confirmation and returning the situation to what it was before, where the federal courts appoint interim USAs after 120 days without Senate confirmation, it specifically stated that the return to the previous condition applied to all USAs currently in place. Bush said he will not try to veto it, but I doubt he's signed it yet -- can he string it out? The 120 day mark has just about hit most if not all of his interim USAs by now. I doubt Congress would let these folks continue as USAs.

I do not think Hatch would qualify for AG. He has managed Republican campaigns, his own. And has no prosecution experience, at least in the legal sense. I find following these investigations to be like watching professional sceet shooting: every time the trap springs, another pidgeon is blown away. No indictments yet, but whenever Bush's lackeys open their mouths the grave gets a little deeper.
It all seems fair enough to me: like real pigeons, this administration has shat on everything under it.
As far as hurrying to impeach or indict these suckers goes, it seems to me that Congress is still in 'discovery.' My guess is that when the evidence is solid, and the case has been made strongly enough to swing over substantial parts of the minority party and the electorate, charges will be filed.

Their records could readily be subpoenaed; if their statement was incorrect, they would have intentionally lied to Congress. As discussed elsewhere, if it puts Goodling in legal jeopardy to accept "free" legal services, they would not put it that way either.

As pointed out on FDL earlier, Goodling's law firm is Akin Gump, to which former RNC chairman Kenneth Mehlman returned as partner on March 1st. That Ken Mehlman.

So, the former chair of the RNC, and "former" RNC computer guru, is a partner at the mega-law firm that has a team of lawyers working for Monica. Whose only known asset is an undetermined equity in a Metro DC home apparently bought a few years ago for less than $300K.

I wonder whose kittens this Kenny Boy's protecting?

I suspect that in some ways, Ms. Goodling finds herself in Pelican Brief territory. She's not the heroine, just someone who knows too much about other people, a trait that is no longer useful but threatening.

She won't cinematically "disappear", but her life will not be her own for some time. Given Akin Gumps' ties to the RNC through Mehlman, she should be concerned about whose interests they will protect first. Ethically, of course, its hers. But that's not the street smart answer along the Potomac.

The stakes are higher than any crimes Goodling's misplaced zealotry may have led her to commit. She is no longer the one most at risk, no matter how much Karl would like to believe it. Mr. Rove may have many faults, but an inability to assess risk and reward is not one of them. Neither is an unwillingness to act in unexpected ways.

If Leahy doesn't want to file subpoenas than perhaps a independent investigation is in order.

Patrick Fitzgerald is quite capiable of throw persons in jail for comtempt. Goodling could simply cool her heels in the slammer for a while. It does wonders for those individuals who just feel they could do whatever the hell the want. That perhaps Monica can get fired just like Juidth Miller. And just like Jusith Miller, few American will care about her job lose.

She should have been fired by now already anyways.

The decorum by the Dems in Congress is necessary. We cannot have our Congressman bullying their "targets" in letters. These letters have quite a bit of b*tch-slap language in them. But to have our elected officials sit in their Committee rooms and say "Liar!" is absurd.

I am enjoying these letters immensely. To see them come out so quickly and say "booyah!" to people like the Attorney General, like our Secretary of State as well as to a very well respected law firm is just jaw-dropping.

As for the repercussions, who knows? This Admin continues to slip, slide and weasel its way out of things right and left. Even Sampson's testimony was just shameful.

Yes, I plan on enjoying AbuG on April 17th, but who knows what we will hear. I am still recovering from Knodell's testimony that his office has yet to conduct a investigation into the leaking of Plame as a CIA agent...

At least we don't have Anon's troll-like commentary here (see Goodling thread)...kind of like "Jake" on Thinkprogress threads.

And while the Democrats may owe the American people some kind of Justice...don't expect the smoking gun. Short of actual impeachment or eradication via terrorism, we're stuck with this crap. One example: see the new recess appointments.
