Former DoJ Official: Department Used to "Skew" Elections

Straight from the horse's mouth.

Joseph D. Rich was chief of the voting section in the Justice Department's civil right division from 1999 to 2005. Today he penned an Op-Ed in The Los Angeles Times, and he didnt' mince words:

Over the last six years, this Justice Department has ignored the advice of its staff and skewed aspects of law enforcement in ways that clearly were intended to influence the outcome of elections.

It has notably shirked its legal responsibility to protect voting rights. From 2001 to 2006, no voting discrimination cases were brought on behalf of African American or Native American voters. U.S. attorneys were told instead to give priority to voter fraud cases, which, when coupled with the strong support for voter ID laws, indicated an intent to depress voter turnout in minority and poor communities.

And Rich gives a specific example of the type of U.S. attorney this administration prefers -- a "loyal Bushie" to be sure:

In March 2006, Bradley Schlozman was appointed interim U.S. attorney in Kansas City, Mo. Two weeks earlier, the administration was granted the authority to make such indefinite appointments without Senate confirmation. That was too bad: A Senate hearing might have uncovered Schlozman's central role in politicizing the civil rights division during his three-year tenure....

Missouri had one of the closest Senate races in the country last November, and a week before the election, Schlozman brought four voter fraud indictments against members of an organization representing poor and minority people. This blatantly contradicted the department's long-standing policy to wait until after an election to bring such indictments because a federal criminal investigation might affect the outcome of the vote. The timing of the Missouri indictments could not have made the administration's aims more transparent.

I've always thought that as long as we have honest elections then the could never be any up rising of the people because it's much easier to vote then to start a revolution.

Has anyone asked themselves while watching the Sampson hearing why Gonzales is attempting to curry the favor of USAs who still have their jobs by going on his hastily arranged national tour of USA offices. Certainly the DOJ employees in USA offices around the nation cannot be happy but they do not control whether he stays employed.

The question came to me as I watched the hearing and thought Sampson's problem as well as Gonzo's and the WH's is not the crowd of employed USAs despite their mood. Their problem is the eight fired USA's, a Democratic Congress that is employing it's oversight authority, a national public that is increasingly unhappy with Bush and most importantly the fact that Gonzo & Co. are clearly guilty of wrong doings surrounding the USA firings.

If Gonzo's problem is not with the employed USAs, why is he touring the nation on a dog and pony show? If he were an elected official it might make some sense. However he isn't elected.

Could Gonzo be "cleaning-house" by delivering face to face messages to various mid-level political appointees employed in the USA offices to dump/destroy any incriminating documents, keep their mouths shut and keep to the "official" cover story as the investigations over the fired USAs heats-up?

Long Memory:

It would be rather innocent, in my opinion, for Gonzo's national tour of USA offices to be merely coincidental.

Look there were hundreds of attorney's who went to Pat Robertson's school of obfuscating the law who were appointed to DOJ jobs. Where did they all work? Did they only work in DC? Is it possible they also worked in key USA offices around the nation? If they did work in USA offices, what were their official and unofficial duties? And what evidence of their work product is on record?

In order to pull this thing off Gonzo and the WH likely needed a network of mid-level "loyal Bushies" to police the career prosecutors toiling in USA offices around the nation. Their presence would be insurance to make sure the career employees did forget that the Bush/Gonzo DOJ was guided by corrupted politics, not principled legal work.

But it's vital that this gets wide attention than just LA Times readers like myself. Madison (y'know, 'father of the Constitution') said that a president wouldn't remove good men for bad reasons because the Senate's confirmation process would open the president to questions of why the replacement was necessary. So they serve at the pleasure (sp!) of the president AND the Senate. Podhoretz screws this up today by saying this rule still holds, when he knows full well that an amendment to the Pat-Riot Act changed this constitutional check on the president by repealing the Senate's confirmation right. It's one of the KEY issues in this AttorneyGate disaster.

Does anyone remember an interview with Rove before the 2006 election on NPR where Robert Siegel pointed out that the polls were leaning toward the Dems. Rove insisted the data he has access to indicates a Repub victory. He smugly said to Siegel regarding the polls: "..but you're entitled to your math, I'm entitled to 'THE MATH'." Where did this unearned confidence come from? I bet 'The math' Rove must have been referring to are the numbers of Democratic votes that he knew wouldn't be counted. Go to USDoJ.com and search 'voter fraud'. Approx 49 links come up. In those links are various speeches, roundtable discussion transcripts and other talking points. AAG Kim and Schlozman (now a USA) were instrumental in pushing the voter fraud issue, and clearly, at the behest of AG AG and Pres. Bush. Read through the roundtable transcript led by AAG Kim. Clearly the White House and AG's office was pushing this.

One point that kept popping out at me: The AG's office is very proud that they have been sending record numbers of 'observers and monitors' to monitor elections. 'Observers' are sent pursuant to the Voting Rights Act and are limited to certain areas defined by the VRA. 'Monitors', however, are DoJ attorneys and employees sent by the DoJ to wherever they want. Curiously, the AG's office does not like to let news orgs know where they are sending anybody. And, also curious, the AG likes to send monitors to areas in which there are close races (but only because that is where voter fraud can change an election, I'm sure.)

Since 2002 or so, there have only been 120+ voter fraud prosecutions with only about 86 convictions. These numbers seem statistically irrelevant (Caveat: I'm no statistician).

We already know that Rove is practicing his own version of Nixon's "dirty tricks"...but on steroids.

From what I can tell, all the U.S. Attorneys and their assistants have been recruited to be part of Rove's "dirty tricks" squad with their "job performance evaluation" depending on how well they helped Rove control the message before any election, primarily through "swift-boating" Democrats with voter fraud allegations, while keeping Republican corruption out of the pre-election headlines.

After last November's election, eight U.S. Attorneys obviously didn't meet Rove's "swift-boat" standards, so they were fired in December, to be replaced apparently with hand-picked Republican "loyal Bushies" and "loyal Rovies" who will meet Rove's "swift-boat" standards, especially in time for the October/November 2008 "swift-boating" season.

Let's not forget, though, that one major Republican scandal disrupted Rove's carefully laid plans just before last year's election...the Mark Foley/House page sex scandal. All through October and election day, news cycles were consumed with sex, sex, sex and revelations that the House Republican leadership had been covering up for a sexual predator in their midst, and for quite some time. Rove lost control of "the message" just before the election, you see.

Thus, David Iglesias in October was being pressured to unseal grand jury indictments being brought against Democrats in New Mexico to help Rep. Heather Wilson in a hotly-contested race, while in Missouri in another close Senate race, "and a week before the election, Schlozman brought four voter fraud indictments against members of an organization representing poor and minority people."

This is all part of the same corrupt pattern, which just makes me wonder how many other Republican-appointed U.S. Attorneys around the country, in an attempt to "control the message" and drive news coverage of the Mark Foley sex scandal into the background, concocted indictments or announced investigations into Democrats just before the election last year? Maybe it just happened in closely contested races in which swinging several hundred or several thousand votes toward the Republican candidate and away from the Democrat might make a difference?

Until all the "loyal Bushie" and "loyal Rovie" Republican political operatives can be cleaned out of the Justice Department, then no American citizen can trust the integrity of anything the Justice Department does. It's as simple as that.

If I thought the republicans were that smart, I might consider that the trashing of the Justice Department (much like their support of an out-of-control "independent" prosecutor) was designed not only to gain immediate advantage but also to make it much more difficult for a democratic (in both senses) administration to prosecute republican corruption.

In practical terms, forcing out huge numbers of qualified career lawyers and replacing them with zealot stooges makes it that much harder to do any real work at all. But in public-relations terms, using the DoJ to go after a party-line enemies list makes it that much harder for future federal prosecutors to win cases against members of the opposing party, period. If a democrat is elected in 2008 and starts making republican corruption a priority, just watch the spin start (if it waits that long) and watch the usual suspects in the media lap it up.

Understand this in the context of the oveall. This weekend Gingrich was speaking and talking about the leaks in DC and the vast left-wing bureaucracy in DC at war against the GOP. He went on to attack the now catch phrase the liberal elite media.

Bolton was on the Daily Show discussing how the President does not have loyalty following his policies throughout the administration and that is why things are so bad.

In both they are saying that even with the laws in place or practice or whatever they want to change the world to their narrower view and promote their advantaged governance.

They went a bridge too far with the DOJ and now will get themselves chopped up. Hopefully it goes to the Oval Office and snares a whole generation of corrupt conservatives without conscience.
