CREW: White House Breaking Records Law?

A number of readers have pointed out that Karl Rove's deputy at the White House, Scott Jennings, used an outside domain, gwb43.com, for his emails. The domain, it turns out, is owned by the Republican National Committee.

Now Citizens for Responsibility and Ethics in Washington has sent a letter to House government reform committee Chairman Henry Waxman (D-CA) requesting an investigation of whether the White House has been violating the Presidential Records Act -- in an attempt to keep certain correspondence away from prying eyes.

Jennings use of the RNC's email "raises serious questions about whether the White House was trying to deliberately evade its responsibilities under the PRA, which directs the president to take all necessary steps to maintain presidential records to provide a full accounting of all activities during his tenure," says CREW.

And there's evidence that Jennings' use of an outside domain was a pattern in Rove's office. CREW points out that Karl Rove's former assistant Susan Ralston also frequently used outside domains to communicate to her old boss, Jack Abramoff.

The Washington Post reported yesterday that House Democrats are also planning on investigating the White House's use of outside domains for correspondence. Namely:

Democratic congressional aides said they will investigate whether using the private address for government business violated laws against using taxpayer resources for political work or signaled that White House officials considered the firing of U.S. attorneys to be primarily a political issue. Jennings did not return a call to his office seeking a comment.

An RNC spokeswoman told the Post that "As a matter of course, the RNC provides server space and equipment to certain White House personnel in order to assist them with their political efforts."

But the question here is whether there is any line between "political efforts" and official duties in the Bush White House.

But the blending of politics and government from this administration has drawn a distinct silence from those same presidential purists. "We don't know if it was illegal" they say now. Its as if the rule books were chucked out the front door on the first day of the Bush administration. Since there are no rules, they couldn't have possibly violated any of them, right?

This administration needs to be held to the same standards of any law-abiding average citizen, at the least, and out of sheer fair play, they should be held to the same standard they applied to the Clinton administration.

This document dump came when President Bush and all of his senior advisors were out of the country in South America and Mexico.

My guess is this was a kneejerk reaction by DOJ (before they could have the records culled/reviewed by the White House) to get in front of the issue.

The reason the President is upset is probably because the Attorney General fed this fire by releasing these documents.

SMTP mail ( email ) is moved from one mail relay to the next until it finds it's destination. There has to be an upper limit on this or emails could circulate forever in a loop on a misconfigured network. nocb.ior.navy.mil decided enough was enough and terminated the attempt to find the correct recipient. So it generated a return email to notify you that it cannot deliver the message. Your email did not succeed. The system has stopped trying to deliver it.

At my employer, they block all non-corporate email ports, so you can't even point a pop3 client at an outside mail server. Pretty much every web-mail service is blocked too. It's partially to protect trade secrets from leaving the building undetected. But also, to close off an avenue for mail trojans, etc.

I'm a bit shocked that similar controls are not in use on the White House's network. I'd be less shocked to know that they ARE in use, but these guys pulled strings (or whatever) to get an exemption.

That these guys are using outside mail servers is a very smelly thing. Probably stinkier than anything they've done so far. It reeks of wrongdoing. (incompetent wrongdoing; since there's much sneakier ways of using covert messaging).

On the other hand - it would be a REAL shame if these mail domains ended up on some russian porn-spammer's mail list. Wouldn't it?

Within most environments where staff deal with classified information (and we can safely assume that the Whitehouse is a major hub for this kind of activity), there exist very clear rules for which computers can handle classified and unclassified information.

As a result, any WH staff who possess security clearances would be accustomed to choosing which computer is used to handle certain types of information. It would be hard to argue that any trained person would be ignorant of why he or she was using any outside servers for sending politically-sensitive government business, such as information about the USA purge.

It might also make a difference which type of computer was used to send those emails to gwb43.com.

We all remember how Rove's office once experienced a little blowback on the use of classified information...

I don't really have a clue about how networks operate but should stuff coming and going from the WH just travel along the BellSouth superhighway?

Doesn't sound all that secure to me.

C-92 is exactly correct. One can limit incoming mail access to certain domains at the server/firewall level normally as a spam filter. But one can also limit outgoing traffic and web mail availability by username, so one official can get offsite web mail and the person next to them (or even the same computer) cannot. Many larger corporations do this now to prevent workers from slacking on youtube, downloading clearly personal emails, sending corporate secrets outside the firm, etc. Often you need managerial approval showing your need for internet or outside communication as part of your job.

In the cleared world, it's even more tightly monitored. And tracked. And backed up to offsite locations. Ever since 9-11 and Enron (Sarbanes-Oxley), disaster recovery and forensic science have been stronger industries than ever. Notably discussed however, (thanks to the DNI efforts on information sharing) the email capabilities are quite thorough though across agency, branch, etc., even to the TS-SCI levels. There is absolutely no need to go outside government channels to communicate...unless you are hiding things from the government itself.

Also, previous logic of email name spoofing falls apart when kr was used on a cc: in one of the dump emails, denoting clearly Karl Rove based on the text. Seems like another method to keep prying eyes/search tools from finding Rove as a username. perhaps we need to review things for GB, DC, CR, or numbers like 41, 43, etc. a username can be anything...like Judge....


To go really crazy , how about the justices? All this was happening about the same time as those confirmations, correct? And Harriet sure wanted to be one of those.

At the end of the day, we may see a means of non-government communication across all three branches for political gain; effectively usurping the constitutional authority of our checks and balances system of government entirely?

Pretty much the only way to ensure proper evidenciary retention is to seize the servers and remove the hard drives. The FBI is very good at this and does it all the time at their Quantico lab facility.

BellSouth is a Wide Area Network (WAN) leasing provider, which encrypts its traffic point-to-point, so it's pretty secure. This is a standard now. Several agencies and companies also further encrypt their lines using their own point-to-point encrypters called TACLanes, same as the intelligence community uses.

Most agencies can't afford their own lines, so they share previously-built ones and put the encryption devices on to keep their data secure.

Out of curiosity, I tried whitehouse.gov on tracert and the trace stops at the SprintLink backbone in Reston VA and that's as far as you can go. Which make sense because people shouldn't know exactly how stuff gets to the WH.

To join the White House, he sold a million dollar consulting company -- a company that's gone from strength to strength as it vaccums up GOP dollars. Yet Karl can't be a part of that.

As we examine this possible secret network of communications, let's also consider the secret network of money and patronage.
