Today's Must Read
With Scooter Libby's trial speeding to a close, the focus today is partly on Libby, but mostly on the man behind the curtain for all of Plamegate: Vice President Cheney.
In National Journal, Murray Waas reports on the ugly facts Cheney avoided having to publicly confront when Libby's defense team suddenly decided not to call him to testify:
At the time that Libby offered his explanation to Cheney [in the fall of 2003, after the Plame investigation had begun], the vice president already had reason to know that Libby's account to him was untrue, according to sources familiar with still-secret grand jury testimony and evidence in the CIA leak probe, as well as testimony made public during Libby's trial over the past three weeks in federal court.Yet, according to Libby's own grand jury testimony, which was made public during his trial in federal court, Cheney did nothing to discourage Libby from telling that story to the FBI and the federal grand jury. Moreover, Cheney encouraged then-White House press secretary Scott McClellan to publicly defend Libby, according to other testimony and evidence made public during Libby's trial.
Before the grand jury testimony, Libby testified that Cheney had only "tilted his head" when he'd heard Libby's recounting of things. And later, after Libby had discovered from his own notes that Cheney himself had actually been the one to tell Libby about Plame, he went back to Cheney. Upon hearing the news, Cheney only said, "From me?" and "tilted his head."
All this is not lost on prosecutors, Waas reports:
If Libby is found guilty, investigators are likely to probe further to determine if Libby devised what they consider a cover story in an effort to shield Cheney. They want to know whether Cheney might have known about the leaks ahead of time or had even encouraged Libby to provide information to reporters about Plame's CIA status, the same sources said.
But wait! That's not all, you Cheneyphiles. The New York Times reports on how the trial has "spotlighted" Cheney's "power as an infighter" (read: liar and manipulator), and The Washington Post reports on how Cheney's influence within the administration has waned in favor of what the paper calls a new "pragmatism" (I think that means problem-solving as opposed to problem-making).
Note: Nothing like a front page exposé in The Washington Post to get results. The Post reports this morning that the Army has suddenly decided to begin repairs on patients' housing at Walter Reed Army Medical Center.

In effect, OVP is arguing that they report neither to the Legislative nor to the Executive, rather they are an "independent entity."
Since the Constitution is a bit more vague on the Vice Presidency, Mr. Cheney and his staff have opted for and interpretation that is, in effect, "if it isn't specifically prohibited, then it's legal."
We saw the same philosophy at work when the White House wanted a bulleted list that defined torture. Anything not on that list, not torture.

Fitzgerald has always known Cheney was the driving force behind the outing of Valerie Plame, and Fitzgerald has always understood the real significance of that outing, even if it seems to have escaped Bob Woodward and most of the rest of the Washington press corps. Only problem is that he is limited in what he can do with that knowledge. The press is not. The general public is still essentially unaware because of the successful spin by the White House and the ease with which the press corps is stimulated like younsters just learning how to play soccer. I guess the ultimate goal re Cheney and the seditious outing of Valerie Plame is for it to become old news of interest only to historians somewhere down the road, if at all. If the war is to become a comma, I guess the outing is an inconsequential speck on the page.
I hope I'm wrong and Cheney very publicly gets turned into a steer for what he has done.

Like a prime minister. This unprecedented view of his role would have shocked Jefferson or Adams, Truman or Nixon. Ike would have quickly squashed the obvious insubordination.
In practice, VP's have only the executive authority delegated to them by the president. This president has allowed Cheney to become co-president. Traditionally, the VP's role in the Senate has been limited to breaking tie votes; A comatose Congress seems to have allowed Mr. Cheney to expand that role, too.
Because his executive branch role is derivative, the legal and political buck stops with the president. Likewise, except in limited circumstances, liability reaches the VP only through the president. A kind of reverse Catch-22.
I hope the Libby trial exposes this constitutional house of cards. A Libby conviction could tip it over.

"One important jurisdiction where 'Misprision of Felony' is still a serious offense is United States Federal law. Under the United States Code, Title 18, Part I, Chapter I, Section 4:
"'Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both.'"

The last piece of evidence presented to the jury, Libby is not being charged for leaking a CIA operative. Are you people so blind to your own Machiavellian take on everything? In a civil action, Cheney could be compelled to take the stand or submit to questionning under oath outside of court, if called by the plaintiff. He can challenge the relevance of questions to the matters claimed, but he can refuse to answer legitimate questions only by asserting his constitutional right not to incriminate himself. That applies only to criminal liability. Since Cheney would be testifying or answering questions under oath, lying would be perjury.
Consequently, Cheney will fight tooth and nail to avoid being subject to a civil court's jurisdiction. An issue he would likely contest all the way to the Supreme Court, if need be. They may well accept the case. Conservatives are in the majority and a civil suit would raise novel questions of the executive's vulnerability to civil liability for what it would claim are official acts.

In the world of Washington power brokering, that would be the kiss of death.
Fitzgerald, Cheney and Libby know exactly what stakes are on the table.

Actually, no one worked there; it was a PO Box. This is the "nominal" cover that the rightwingers constantly try to muddy the waters with.
When Plame was overseas she was a case officer and ran sources, etc. The reason she was given nominal cover was to protect her sources and CIA methods after she completed the covert portion of her assignment. The CIA assumed, incorrectly it seems, that once Plame was back in the USofA that she needed only enough cover to protect her sources from people checking up on her from outside the US.
