House GOP: Don't Hurt Us -- Please

Republicans aren't yet an official minority in the House, but they're already beginning a campaign to portray themselves as victims of a heartless Democratic majority.

In a "Dear Colleague" letter circulated to fellow Republicans, three House GOPers are trying to push a "Minority Bill of Rights" -- based on a two-year-old proposal by then-Minority Leader Nancy Pelosi (D-CA). You can read the letter here.

"Unfortunately, as you are well aware, the Democrats' forty-year reign over the House was plagued by consistent, systematic efforts to usurp the rights and privileges of the Republican minority," write Reps. Patrick McHenry (R-NC), Eric Cantor (R-VA) and Tom Price (R-GA).

They don't mention their party's own strongarm tactics -- which is striking, given that since 2002 Cantor himself was a member of the House GOP leadership, which was known for ruthlessly engineering legislative victories. "[R]eveling in the power they have, [Republicans] are using techniques to jam bills through even when they don't have to . . . simply because they can," is how congressional expert Norman Ornstein characterized the GOP's screw-the-minority tactics from 1994 to the present, according to a 2004 Washington Post article.

Republicans "have taken every one of the techniques that Democrats employed when they were in the majority, and ratcheted them up to another level," said the American Enterprise Institute scholar.

An ironic case in point: When Pelosi made her proposal to protect Democrats in 2004, GOP House Speaker Dennis Hastert (IL) refused to entertain the idea, let alone reply to her correspondence.

One can only assume that McHenry, Cantor and Price are hoping for a more sympathetic audience with Pelosi than the one she received then.

Here's the Pelosi Minority Bill of rights from 2004:

"Respectful of both the wishes of the Founders, and the expectations of the American people, we offer the following principles for restoring democracy in the "People’s House," guaranteeing that the voices of the people are heard.

I. Bipartisan Administration of the House

There should be regular consultations among the elected leaders of both parties to discuss scheduling, administration and operations of the House.

- The House should have a predictable, professional, family-friendly schedule that allows the legislative process to proceed in a manner that ensures timely and deliberate dispensation of the work of the Congress.

- Similar, regular meetings between Chairs and Ranking Members of committees, and staffs should be held.

- The minority should control at least one-third of committee budgets and office space.

II. Regular Order for Legislation

The legislative process in the House should return to a more regular democratic order at every level.

- Bills should be developed following full hearings, open subcommittee and committee markups, with appropriate referrals to other committees. Members should have at least 24 hours to examine a bill prior to consideration at the subcommittee level.

- Bills should generally come to the floor under a procedure that allows open, full, and fair debate consisting of a full amendment process that grants the minority the right to offer its alternatives, including a substitute.

- Members should have at least 24 hours to examine bill and conference report text prior to floor consideration. Rules governing floor debate must be reported before 10 p.m. for a bill to be considered the following day.

- Floor votes should be completed within 15 minutes, with the customary 2-minute extension to accommodate Members’ ability to get to the House Chamber to cast their vote. No vote shall be held open in order to manipulate the outcome.

- House-Senate conference committees should hold regular meetings (at least weekly) of all conference committee Members. All duly-appointed conferees shall be informed of the schedule of conference committee activities in a timely manner, and given ample opportunity for input and debate as decisions are made toward final bill language.

- The Suspension Calendar should be restricted to non-controversial legislation, with minority-authored legislation scheduled in relation to the party ratio in the House."

I wouldn't be suprised if Pelosi (via incoming Chair of the Committee on Rules Rep. Louise Slaughter (D-Kick Ass) institutes something exactly like she introduced in 2004. This GOP effort is considerably different than what Pelosi proposed if you read the fine print.

1). They do not apply to any members of the GOP who were elected from 1994 to 2006 .

2). As someone else here suggested, they do not come into effect until 1/1/2009.

I would bet that everyone on this message board bemoaned the Republicans for not allowing the minority Democrats privileges. Who among us has not attacked endless voting periods; who didn't attack Sennsenbrenner for cutting the mikes during the Conyers hearing; who here didn't mind when the Senate Intel Committee released a reort with absolutely no minority representation stating the WMD threat had not been politicized?

If you were ok with all of this then you have every right to support Congressional Democrats in operating the same way.

I believe our leaders need to give the republicans these rights not to fulfill some campaign promise, but to show them and the rest of America that we are indeed the better party because we value fairness, honesty, and integrity over petty partisanship.

We've seen denial, anger, now we must be at the bargaining stage. Depression will come when investigations start and it REALLY sinks in that they're all but powerless to do anything about it. As a Republican for the last 30 years or so, I have been nothing but disgusted with the direction that the House (and Senate, but at least it was better than the House) went in during the last 12 years. There was a time when "honor" and "fairness" were concepts that both sides embraced. Unfortunately, that time seems to be well gone.

However, I have hopes for the latest group of new Democratic Representatives. On the whole, the newcomers seem to be more grounded, less creatures of elite politics, and less ideologues than most in Congress have become. If the next election cycle throws out another 20-30 incumbents, and replaces them with more people like the current freshman class (of whichever party - Republican, Democrat, independent, Green, whatever), then I will start hoping that the Congress will move from the current dysfunctional mess into a body for debate, deliberation, and governance again.

Oh, and if I were in soon-to-be-Speaker Pelosi's position, I would indeed bring forward the Minority Bill of Rights proposal again.

After, oooooh, about 101 hours, perhaps.
